Arbitration is more private, streamlined and often less expensive than litigation. In arbitration, a neutral third party hears the evidence offered by both sides and issues a binding formal decision. The advantage of arbitration is the certainty that a final decision will be reached without protracted litigation and appellate review. The disadvantage is that the parties do not have an opportunity to play a significant role in shaping the final outcome or the opportunity to seek appellate review.

My stellar reputation led the State Bar of Wisconsin ADR Section to invite me to author its amicus brief in Borst v. Allstate Insurance Co. (2006 WI 70, 291 Wis. 2d 361, 717 N.W.2d 42), a case that gave the Wisconsin Supreme Court an opportunity to clarify several ill-defined aspects of the arbitration process. In its unanimous opinion, the court adopted much of the reasoning presented in the amicus brief I authored, providing clarity to lawyers, litigants and arbitrators about the rules that now govern arbitration in Wisconsin.
