It is common when a legal dispute arises between two or more parties to immediately think of the implications if the case goes to court. However, for many civil matters, there is a less expensive, less adversarial and less public way to resolve a conflict: alternative dispute resolution (ADR).

My name is Mark Frankel, founding attorney for Frankel ADR, LLC. My firm focuses on providing services as a mediator or neutral party in a variety of legal contexts. ADR is not the right path for every legal battle, but has many advantages over the very public and sometimes costly route of a civil lawsuit. My work as a mediator is strengthened by my 20 years of experience as a judge in Dane County Circuit Court, and other mediation work in private practice.

ADR Methods Provide Flexibility

If your attorney suggests trying ADR, understand that they are not just one, but several types of dispute resolution methods. Some of the most common are:

  1. Mediation. This involves the neutral party working with the conflicting parties to develop a mutually satisfactory settlement. The mediator in this case is a facilitator, not a decision-maker.
  2. Arbitration. In this case, the neutral (called an arbitrator) is trusted for his expertise in a legal topic. Arbitrators create binding decisions that the parties in the conflict are obliged to follow.
  3. Mediation-Arbitration, or Med-Arb. This option can provide the opportunity for an out-of-court settlement even when mediation fails. The same neutral can be used once the conflict enters the arbitration phase.
